What you can complain about

Any “deficiency in service” by us: any shortfall or inadequacy in a service we are required to provide, whether or not it caused you a financial loss.

Complain to us first

You must first complain to Prest Loans, in writing or otherwise. The RBI Ombudsman will not take up a complaint that was not first raised with us.

When you can go to the Ombudsman

  • We haven’t replied within 30 days of receiving your complaint, or
  • We rejected it, or
  • You’re not satisfied with our reply.

Time limit

You must file within 90 days of the date our 30-day period ends, or of our last communication, whichever is later.

How to file

Online through the CMS portal (https://cms.rbi.org.in), by email (crpc@rbi.org.in), or by signed letter to the CRPC (addresses above). Keep ready a copy of your complaint to us, our reply (if any), and supporting documents.

When a complaint won’t be accepted

  • The same grievance is already pending before or decided by the Ombudsman, or
  • Is pending before or decided by a court, tribunal, arbitrator or other forum, or
  • Is time-barred under the Limitation Act, 1963, or
  • Is abusive, frivolous or vexatious, or lacks the required information.

Matters outside the Scheme

  • A lender’s commercial judgment, such as a decision on whether to sanction a loan
  • Disputes between a vendor and a lender, or between two lenders
  • Complaints against management or executives
  • Employer–employee disputes
  • Actions taken to comply with court or statutory orders
  • Matters with a remedy under Section 18 of the Credit Information Companies (Regulation) Act, 2005

Process & Award

  • The Ombudsman first tries to settle the complaint through facilitation, conciliation or mediation.
  • If it isn’t settled, the Ombudsman may pass an Award.
  • You must accept the Award in writing within 30 days, or it lapses.
  • Once you accept it, we must comply within 30 days.

Compensation

  • There is no limit on the amount in dispute that can be awarded.
  • In addition, up to ₹30 lakh for consequential loss.
  • Up to ₹3 lakh for loss of time, expenses, harassment and mental anguish.

Appeal & Representation

Appeal: The Appellate Authority is the Executive Director in charge of RBI’s Consumer Education and Protection Department. You may appeal within 30 days of receiving the Award or rejection; this can be extended once by up to 30 days.

Representation: You may complain yourself or through an authorised representative. The representative cannot be an advocate, unless the advocate is the complainant.
